Beware of BSAs | The Software Alliance Soft Audits – IT and Internet

To print this article, all you need to do is be registered or log in to Mondaq.com.

We have received several reports from soft audits conducted by BSA | The Software Alliance involving Adobe software. Similar to what Oracle sales teams seem to be doing with Java, the BSA is contacting customers with letters demanding that the company take certain actions, including taking inventory of software and submitting proof of license purchase. and other information to the BSA. These are not formal audit notices sent under the audit provision of the Adobe license, but appear to be fishing expeditions where BSA may be, in our view, looking for a opportunity for additional sales and income. We advise companies on how to respond to these notifications, as well as formal BSA audits.

In addition to Adobe, BSA’s global members include Autodesk, Cisco, IBM, Microsoft, Salesforce, and SAP, among other well-known software vendors. Although Oracle is a global member of BSA, we know that its audits are typically conducted by Oracle’s own internal licensing arm, LMS or GLAS. If you are a business that receives notice from BSA regarding your use of software, we are experienced software licensing attorneys and can advise you on your contractual rights.
